根据澳洲统计局与中国商务部的数据,2009-2010财年,澳洲对华货物贸易总量为829亿澳元,占澳洲货物贸易总量的20.5%。其中,对华货物出口465亿澳元,同比增长18.3%,占全澳货物出口总量的23.2%。中国首次超过日本(371亿澳元),成为澳洲的第一大出口国,出口总额几乎是澳洲对排名第3-5位的东盟10国、韩国和印度三经济体出口额的总和。因此,中澳经贸交流发展迅速,相关税收问题越来越受到关注,亟需研究和应对。

澳大利亚税法研究室是中国政法大学财税法研究中心设立的以中国税法和澳大利亚税法及其比较为对象的职能机构。其主要研究任务包括:(1)研究澳大利亚税法的历史发展、理论学说,澳大利亚公司所得税法、个人所得税法等主要税法的基本内容,澳大利亚税制改革、税收立法及其动态,澳大利亚税收征管制度及其经验,澳大利亚税务律师、会计师等税法中介业务发展情况,澳大利亚税法教育情况等。(2)研究中国税法历史发展、理论学说,中国主体税法的基本内容,中国税制改革和税收立法动态,中国税法服务业务等。(3)研究中澳双边税收协定的基本内容及其适用问题,研究中澳企业双边投资税收问题、双边贸易税收问题、双边人员交往和技术贸易税收问题。(4)研究中澳企业双边并购重组税收问题,合理进行税收规划。(5)研究促进中澳经贸发展的税收政策、税法适用和征管问题,包括消除双重征税、合理避税和打击逃税、税务合作和税收争议解决机制,消除税收障碍。(6)促进中澳两国税法学术交流、教育合作和人员互访。

澳大利亚税法研究室主任由薛仁森博士担任。

薛仁森,法学博士,澳大利亚籍人,现为北京易金卡网络技术有限公司总裁。

薛仁森拥有超过30年互联网、科技与信息行业的工作经验,并且掌握了卓越的企业管理技巧。曾任职于美国、亚太地区的多家知名跨国公司如Wyse,Micro Sales,Dataprep,ICS,Martone,香港电讯等 。注册会计师的专业背景为其作为企业管理者提供了有力的保障。

他于2007年9月12日把自己创办在香港的溢讯通讯有限公司成功的带到纽约证券交易所管理的欧洲证券交易所上市,股票代码:MLEAS。

于2008年4月,一群以皮特诺顿先生(Mr. Peter Norton)及萊纳德兰黛先生(Mr. Leonard Lauder)为首的美国投资者邀请他为美国易金卡(eChinaCash Inc.)作顾问,后成为该公司总裁,全权负责他们在北京向中石化提供的忠诚度计划、市场营销和增值服务等业务。在2012年的第三季度,易金卡已成功协助中石化在全国发行了超过6500万张加油卡。

 

 

Sino-Australia Tax Research Centre

According to the data provided by the Australian Statistic Department and the Chinese Ministry of Commerce, the total Australian goods in trading with China was AU$82.9 billions dollars in the 2009/2010 financial year.  It represented a 20.5% of the entire Australian goods in trading, with which, Australia exported AU$45.5 billions dollars of goods to China and it had an 18.3% increase compared to the financial year before and it represented 23.2% of the overall Australian export trade.  China surpassed Japan (AU$37.1 billions dollars) the first time becoming Australia’s no. 1 exporting country.   The total value of exported goods nearly equal to the total value of goods exported to the 3rd to 5th places of the 10 Asean countries plus Korea and India.

The Sino-Australia Tax Research Centre is established by the Tax Law Research Centre of the China University of Political Science and Law.  The Centre is a functional organization for studying and comparing Chinese tax law and tax law in Australia.  Its main tasks include: (1) to research the basic contents of the historical development of Australian tax law, its doctrine, the Australian company income tax law, the personal income tax law; the Australian tax reform; the Australian tax legislation and its dynamics; the Australian tax collection system and experiences; the business development of Australian tax lawyers, tax accountants and other tax related intermediaries and, the situation of Australian tax law education. (2) to study the historical development of the Chinese tax law, its doctrine, the basic contents of the main tax laws; tax reform and tax legislation and its dynamic and, the business of tax services, etc. (3) to study the basic contents of the Sino-Australia bilateral tax treaty and its applicable issues; the Sino-Australia bilateral corporate investment tax issues; the bilateral trade and tax issues and the bilateral personnel exchanges and technical trading tax issues. (4) to study the Sino-Australia bilateral tax issues regarding corporate merge & acquisition and, how to implement reasonable tax planning. (5) to research for the appropriate tax policy for promoting the trade and economic development for Sino-Australia; the applicable tax law and tax collection management issues, including the elimination of double taxation, what is reasonable tax avoidance and how to combat tax evasion; the tax cooperation and tax dispute resolution mechanism and, how to eliminate tax obstacles. (6) to promote tax academic exchanges between China and Australia; to organise educational cooperation and personnel exchange visits.

Dr. Sylvester S. Silas is the Director of the Sino-Australia Tax Research Centre.

Mr. Sit has more than 30 years of experiences in the ICT industry and, mastered excellent entrepreneurial management skill set. He worked for many famous international corporations in Asia Pacific and USA, such as Wyse, Micro Sales, Dataprep, ICS, Smartone, HK Telecom, etc. He has a very solid CPAprofessional background, which proven to be very useful for managing the corporate reign.

He set up Easson Telecom Ltd (ETL) in Hong Kong in 2002 and the company was successfully listed on the NYSE Euronext (Marche Libre) stock exchange on 12th September 2007.

In April 2008, Sylvester was invited by a group of US investors (including Mr. Peter Norton and Mr. Leonard Lauder) to join eChinaCash Inc. (eCC) as a consultant then became the President of the company for managing their Beijing operation, which provides loyalty program, marketing and value added services for Sinopec. By the 3rd quarter of 2012, eCC had assisted Sinopec issuing more than 65 millions gas cards in the Chinese market.
